Rubbish Collection Colliers Wood Service Terms

These Terms and Conditions set out the basis on which we provide our rubbish collection services in and around Colliers Wood. By booking or using our waste collection services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any rubbish collection, waste clearance, bulky waste removal, or related services provided by us.

Customer or you means the person, business, or organisation requesting or receiving the Service.

We, us or our means the service provider offering rubbish collection in the Colliers Wood area.

Premises means the property, building, site, or location where the Service is to be carried out.

Waste means any items, materials, or rubbish that you ask us to remove, collect, or transport.

2. Scope of Service

We provide rubbish collection and related waste removal services for domestic and commercial customers. The precise scope of any Service, including the type and quantity of waste, the collection date, and the price, will be agreed at the time of booking.

We reserve the right to refuse any waste that is hazardous, prohibited by law, improperly described, or unsafe for our staff to handle. This includes, but is not limited to, certain chemicals, asbestos, explosives, medical waste, and items containing dangerous substances.

Our Service does not include cleaning or repair of areas after waste removal unless specifically agreed in writing as an additional service.

3. Booking Process

You may request a booking for rubbish collection by telephone, email, or online form where available. When making a booking request, you must provide accurate information, including:

1. Your name, contact details, and address of the Premises;
2. A description of the waste to be collected, including type, approximate quantity, and any special handling needs;
3. Any access restrictions, parking limitations, or time constraints at the Premises.

We will review your request and may ask for further information, including photographs or an itemised list, to provide an accurate quotation. A booking is only confirmed when we have accepted your request and you have accepted our quoted price and any applicable terms set out in that quotation.

We reserve the right to decline any booking request at our discretion. Bookings are subject to staff availability, vehicle availability, and the operational constraints of our waste collection routes.

4. Access and Customer Responsibilities

You are responsible for providing safe, reasonable, and lawful access to the Premises at the agreed time of collection. This includes ensuring that:

1. There is adequate parking or stopping space for our vehicle in proximity to the Premises;
2. Any required permits or authorisations for parking or access are in place before our arrival;
3. All waste to be collected is ready for removal and is clearly identified.

If the Service requires entry into a building or secured area, you must ensure that someone with authority is present to grant access at the scheduled time. If we are unable to gain access or to carry out the Service due to access issues or safety concerns, we may charge a missed visit or call-out fee.

You must not include in the waste any items that are hazardous or prohibited by law. If we discover such items during collection, we may refuse to remove them, adjust the price, or cancel the Service entirely, and we may charge for any time already spent on site.

5. Pricing and Quotations

Prices for our rubbish collection services are usually based on factors such as the volume, weight, and type of waste, labour involved, access conditions, and distance from our operating base. Any quotation provided prior to the collection is an estimate only and may be subject to change if the information you supplied was incomplete or inaccurate, or if the volume or type of waste presented differs significantly from that described.

We will notify you of any necessary adjustment to the price before commencing the Service. If you do not agree to the revised price, you may cancel the Service, but we reserve the right to charge a reasonable fee for our time and any costs incurred in attending the Premises.

6. Payment Terms

Unless otherwise agreed in writing, payment for the Service is due on completion of the rubbish collection at the Premises. We may accept payment by cash, debit card, credit card, or bank transfer, subject to availability of payment methods.

For business customers or larger jobs, we may require full or partial payment in advance, or may agree specific invoicing terms. Any such terms will be confirmed at the time of booking.

If payment is not made when due, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover from you all reasonable costs incurred in obtaining payment, including legal and debt collection costs.

7. Cancellations and Rescheduling

You may cancel or reschedule a booked Service by contacting us as soon as possible. The following will apply unless otherwise stated in your quotation or confirmation:

1. If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually apply.
2. If you cancel within 24 hours of the scheduled collection time, we may charge a cancellation fee to cover our administrative and scheduling costs.
3. If we attend the Premises and are unable to carry out the Service due to your act or omission, including lack of access or absence of an authorised person, we may charge a call-out or missed visit fee.

We will use reasonable efforts to accommodate any request to reschedule, but we cannot guarantee availability on your preferred alternative date or time.

We may cancel or reschedule the Service due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness, safety concerns, or changes in waste disposal regulations. In such cases, we will inform you as soon as reasonably practicable and offer a new appointment. We will not be liable for any losses arising from such cancellation or delay, other than a refund of any amounts paid for services not provided.

8. Performance of the Service

We will carry out the rubbish collection with reasonable care and skill and in accordance with applicable waste management regulations in the United Kingdom. Our staff will remove the agreed waste from the Premises and load it into our vehicle, taking reasonable steps to avoid unnecessary damage to property.

We are not responsible for clearing or dismantling items that have not been included in the booking, unless agreed with you on site and subject to any additional charges. You are responsible for ensuring that any items to be removed are free from personal data, confidential documents, or valuable possessions.

9. Title and Risk in Waste

Once we have collected the waste and loaded it into our vehicle, you relinquish ownership of that waste and we assume responsibility for transporting it to an appropriate disposal or recycling facility. Risk in the waste passes to us upon collection, subject to these Terms and Conditions.

We will handle and dispose of all collected waste in accordance with applicable waste regulations and our own environmental policies. However, we reserve the right to refuse or return any items that were misdescribed, hazardous, or unlawfully included in the waste stream.

10. Compliance with Waste Regulations

Our rubbish collection services are operated in accordance with UK waste legislation and relevant local requirements. We will only transport and dispose of waste at licensed, permitted, or otherwise lawful facilities, and we will follow all applicable duty of care obligations for waste carriers.

By using our Service, you confirm that the waste presented for collection has been generated lawfully and that you have the legal right to dispose of it. You must not request collection of waste that you are prohibited from disposing of, or that has been obtained unlawfully.

If you are a business customer, you may be required to provide certain information about the nature of the waste, and we may issue documentation such as a waste transfer note where required by law. You must retain any such documentation for the legally required period.

11. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to the above, we will not be liable for:

1. Any indirect, consequential, or economic loss, including loss of profits, loss of business, or loss of opportunity;
2. Any loss or damage arising from inaccurate information you have provided, including misdescription of waste or access conditions;
3. Any damage to items or property that were not clearly identified as fragile or requiring special handling, or where such handling was not reasonably practicable.

Where damage occurs to your property as a direct result of our negligence, you must notify us as soon as reasonably possible and in any event within 7 days of the collection. Our liability for such damage will, where lawful, be limited to the cost of repair or replacement of the damaged item or property, taking into account its age and condition.

Our total liability to you for all claims arising out of or in connection with any Service, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable for that specific Service, except where such limitation is not permitted by law.

12. Customer Indemnity

You agree to indemnify and hold us harmless against all claims, losses, damages, costs, and expenses arising from:

1. Any breach by you of these Terms and Conditions;
2. Any misdescription of the waste or failure to disclose hazardous or prohibited items;
3. Any claim made against us by a third party in connection with the waste or the Premises, where such claim arises from your act or omission.

13. Data Protection and Privacy

We will collect and use your personal information only for the purposes of managing your booking, providing the Service, handling payments, and complying with our legal obligations. We will take reasonable steps to protect your data and will not sell or disclose your information to third parties except where necessary for the performance of the Service or required by law.

14. Changes to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements, or our business practices. Any revised terms will be published and will apply to new bookings from the date of publication. For existing confirmed bookings, the version in effect at the time of booking will usually continue to apply, unless a change is required by law.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with any Service, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or any Service, including any non-contractual disputes or claims.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us in relation to the provision of rubbish collection services and supersede all previous agreements, understandings, or arrangements, whether written or oral.

By placing a booking and allowing us to carry out a rubbish collection at your Premises, you confirm that you have read, understood, and agreed to these Terms and Conditions.
